Duty To Manage

Under this legislation if you have building/maintenance/repair responsibilities for your organisation/ premises you will be required to manage the risk from asbestos exposure by:

  1. Taking reasonable steps to determine the location of materials likely to contain asbestos.
  2. Assume all materials contain asbestos, unless there is sufficient evidence to say otherwise.
  3. Make and maintain a written record of the asbestos and assumed asbestos materials (REGISTER).
  4. Monitor the condition of any asbestos materials on a regular basis.
  5. Assess the risk of exposure, and document action necessary to manage the risk.
  6. Prepare a plan to put the above steps into action and put your plan into action.
  7. Ensure anyone likely to come into contact with asbestos has information on asbestos locations.

Should a premises undergo refurbishment or demolition works, then an Asbestos survey shall also be required under the Construction (Design and Management) Regulations 1994. The Asbestos (Licensing) Regulations 1983, prohibits work with Asbestos insulation, coatings and Asbestos Insulation Board by an employer or self-employed person, without a licence granted by the Health & Safety Executive.
